01About these terms
These terms apply to your use of this website and to any services you buy from Advance Media Solution ("AMS", "we", "us"). By using the site or accepting a proposal from us, you agree to them.
Each project also has a written proposal or quotation that sets out the scope, deliverables, timeline and fee. If the proposal says something different from these terms, the proposal wins for that project.
02Our services
We provide social media marketing, website design and development, Google and Meta advertising, and content production including photo and video shoots. What is included in your engagement is exactly what the proposal lists. Anything outside it is extra work, which we will quote before starting.
03Your responsibilities
- Give us accurate information, timely feedback and the access we need to do the work.
- Make sure you own, or have permission to use, every logo, photo, video, music track, testimonial and piece of text you send us.
- Check and approve content before it is published. Once you approve it, you are responsible for it being accurate and lawful.
- Make sure your products, services and claims comply with the law and with the policies of each platform we advertise on.
Delays in feedback, approvals, content or access will move the timeline, and may affect how much of a monthly plan can be delivered that month.
04Fees and payment
- All fees are in Indian Rupees and GST is charged on top where applicable.
- Monthly retainers are billed in advance at the start of each month.
- One-time projects, such as websites and shoots, need an advance before work starts. The rest is due on delivery unless the proposal sets milestones.
- Invoices are due within 7 days. We may pause work on accounts with overdue invoices until they are paid.
- Travel, location, talent, props and equipment hire for shoots are charged at cost, and agreed with you in advance.
05Advertising spend
Ad spend is separate from our management fee. It is paid by you directly to Meta, Google or the relevant platform, using your own payment method on your own ad account, unless we agree otherwise in writing.
Platforms decide how ads are delivered, approved and charged. We are not responsible for platform outages, account restrictions, ad rejections or policy changes, but we will help you resolve them.
06Results
We commit to doing the work well and reporting honestly on how it performs. We do not guarantee specific numbers of followers, views, leads, sales or search rankings, because those depend on your market, your product, your budget and the platforms. Past results shown on this site are real, but they are not a promise of the same result for you.
07Ownership of work
Once you have paid in full for a deliverable, you own the final version we delivered: the published posts, edited videos, photos, designs and website.
We keep ownership of raw footage, unused takes, project and source files, templates and our own methods and tools, unless the proposal says they will be handed over. Source files can be bought separately.
Stock media, fonts, music and software are licensed from their owners under their own terms, which you must follow.
We may show finished work in our portfolio, on this website and on our social media. If you need the work kept private, tell us in writing and we will not.
08Accounts and access
Your social media pages, ad accounts, domain, hosting and website remain yours. We will use any access you give us only to do the agreed work, and will hand back or remove access when the engagement ends.
09Confidentiality
We keep your business information, unpublished content, figures and login details confidential, and ask the same of anyone who works on your account. This does not apply to information that is already public or that we are legally required to disclose.
10Ending an engagement
Monthly engagements continue month to month after any minimum term in the proposal. Either side can end them with 30 days' written notice. Fees for work already done, and for the notice period, remain payable. Our Refund & Cancellation Policy explains what happens to money already paid.
Either side can end an engagement immediately if the other seriously breaches these terms and does not fix it within 15 days of being told.
11Limit of liability
To the extent the law allows, our total liability for any claim relating to a project is limited to the fees you paid us for that project, or for the three months before the claim for retainers. We are not liable for indirect losses such as lost profit, lost data or damage to reputation, or for losses caused by platforms, hosting providers or other third parties.
You agree to cover any loss we suffer because content or materials you supplied infringe someone else's rights or break the law.
12Using this website
The content of this website, including text, design, images and videos, belongs to AMS or to the clients whose work is shown. You may view and share links to it, but not copy, republish or use it commercially without permission.
13Governing law
These terms are governed by the laws of India. Any dispute will first be discussed in good faith. If it cannot be settled, the courts at Rudrapur, Udham Singh Nagar, Uttarakhand, will have exclusive jurisdiction.
